土壤污染防(fang)治(zhi)行動計劃

土(tu)壤(rang)是經濟社(she)會可(ke)持(chi)續(xu)發展的物(wu)質(zhi)基礎,關(guan)系(xi)(xi)人(ren)民群眾身體健康,關(guan)系(xi)(xi)美麗中國建設,保護(hu)好土(tu)壤(rang)環境(jing)是推(tui)進生(sheng)態(tai)(tai)文(wen)明建設和(he)維(wei)護(hu)國家生(sheng)態(tai)(tai)安全(quan)(quan)的重要內(nei)容。當前(qian),我國土(tu)壤(rang)環境(jing)總體狀況(kuang)堪憂,部(bu)分地區污染較為嚴重,已成(cheng)為全(quan)(quan)面建成(cheng)小康社(she)會的突出短(duan)板之一。為切實加(jia)強土(tu)壤(rang)污染防治,逐(zhu)步改善土(tu)壤(rang)環境(jing)質(zhi)量,制定本行動計劃。

總體要(yao)求(qiu):全(quan)(quan)面貫徹黨的(de)十八大和(he)(he)十八屆三中(zhong)、四中(zhong)、五中(zhong)全(quan)(quan)會精神,按照“五位一體”總體布局(ju)和(he)(he)“四個全(quan)(quan)面”戰略布局(ju),牢(lao)固樹立(li)(li)創(chuang)新(xin)、協調、綠色、開(kai)放(fang)、共享(xiang)的(de)新(xin)發(fa)(fa)展(zhan)理(li)念,認真落實(shi)黨中(zhong)央、國(guo)(guo)務院決策(ce)部署,立(li)(li)足我國(guo)(guo)國(guo)(guo)情和(he)(he)發(fa)(fa)展(zhan)階(jie)段,著眼(yan)經濟社會發(fa)(fa)展(zhan)全(quan)(quan)局(ju),以改善土壤環境質量為核心,以保障(zhang)農產(chan)品(pin)質量和(he)(he)人居環境安全(quan)(quan)為出(chu)發(fa)(fa)點(dian),堅(jian)持預防為主、保護(hu)優先、風險管控,突出(chu)重(zhong)點(dian)區域、行業和(he)(he)污染物,實(shi)施分(fen)類(lei)別、分(fen)用途、分(fen)階(jie)段治理(li),嚴控新(xin)增污染、逐步減(jian)少存量,形成政(zheng)府主導、企業擔責(ze)、公眾(zhong)參與(yu)、社會監(jian)督的(de)土壤污染防治體系,促進土壤資源永續利(li)用,為建設“藍天(tian)常在(zai)、青山常在(zai)、綠水常在(zai)”的(de)美麗(li)中(zhong)國(guo)(guo)而奮斗。

工作目標:到2020年(nian),全(quan)國土(tu)壤污染加重趨勢得(de)到初步遏制,土(tu)壤環境(jing)(jing)質量總體(ti)保(bao)持穩定(ding),農用地(di)(di)和建設用地(di)(di)土(tu)壤環境(jing)(jing)安(an)全(quan)得(de)到基本保(bao)障,土(tu)壤環境(jing)(jing)風險得(de)到基本管控(kong)。到2030年(nian),全(quan)國土(tu)壤環境(jing)(jing)質量穩中(zhong)向好,農用地(di)(di)和建設用地(di)(di)土(tu)壤環境(jing)(jing)安(an)全(quan)得(de)到有效保(bao)障,土(tu)壤環境(jing)(jing)風險得(de)到全(quan)面管控(kong)。到本世紀中(zhong)葉,土(tu)壤環境(jing)(jing)質量全(quan)面改善(shan),生態(tai)系(xi)統實(shi)現良(liang)性(xing)循環。

主(zhu)要(yao)指標(biao):到(dao)2020年,受污(wu)染耕地(di)安(an)全利(li)用(yong)率(lv)(lv)(lv)達到(dao)90%左(zuo)右,污(wu)染地(di)塊安(an)全利(li)用(yong)率(lv)(lv)(lv)達到(dao)90%以(yi)上。到(dao)2030年,受污(wu)染耕地(di)安(an)全利(li)用(yong)率(lv)(lv)(lv)達到(dao)95%以(yi)上,污(wu)染地(di)塊安(an)全利(li)用(yong)率(lv)(lv)(lv)達到(dao)95%以(yi)上。

一、開(kai)展土壤污染調查,掌握(wo)土壤環境質量狀況

(一)深入(ru)開(kai)(kai)展(zhan)土(tu)(tu)壤環(huan)境質量(liang)調查(cha)。在現(xian)有(you)相關調查(cha)基礎上,以農用(yong)(yong)地(di)(di)和(he)(he)重點(dian)行業(ye)(ye)企(qi)業(ye)(ye)用(yong)(yong)地(di)(di)為重點(dian),開(kai)(kai)展(zhan)土(tu)(tu)壤污(wu)(wu)染(ran)狀況詳查(cha),2018年(nian)(nian)底前(qian)查(cha)明(ming)農用(yong)(yong)地(di)(di)土(tu)(tu)壤污(wu)(wu)染(ran)的(de)(de)面積、分布及其(qi)對農產品質量(liang)的(de)(de)影響;2020年(nian)(nian)底前(qian)掌握重點(dian)行業(ye)(ye)企(qi)業(ye)(ye)用(yong)(yong)地(di)(di)中的(de)(de)污(wu)(wu)染(ran)地(di)(di)塊分布及其(qi)環(huan)境風險情況。制定詳查(cha)總體方(fang)案和(he)(he)技術(shu)規(gui)定,開(kai)(kai)展(zhan)技術(shu)指導(dao)、監督檢查(cha)和(he)(he)成果審核。建立土(tu)(tu)壤環(huan)境質量(liang)狀況定期調查(cha)制度,每10年(nian)(nian)開(kai)(kai)展(zhan)1次。(環(huan)境保護部牽頭,財政部、國(guo)土(tu)(tu)資源(yuan)部、農業(ye)(ye)部、國(guo)家衛(wei)生計生委等參(can)與,地(di)(di)方(fang)各級人民政府(fu)負(fu)責落實。以下(xia)均需地(di)(di)方(fang)各級人民政府(fu)落實,不再(zai)列出)

(二)建(jian)設(she)土壤(rang)環(huan)(huan)境(jing)質(zhi)量(liang)(liang)監(jian)(jian)(jian)測網絡(luo)。統一規劃(hua)、整合(he)優化土壤(rang)環(huan)(huan)境(jing)質(zhi)量(liang)(liang)監(jian)(jian)(jian)測點(dian)位(wei),2017年(nian)底(di)前,完成土壤(rang)環(huan)(huan)境(jing)質(zhi)量(liang)(liang)國控監(jian)(jian)(jian)測點(dian)位(wei)設(she)置(zhi),建(jian)成國家土壤(rang)環(huan)(huan)境(jing)質(zhi)量(liang)(liang)監(jian)(jian)(jian)測網絡(luo),充分發(fa)揮行(xing)業(ye)監(jian)(jian)(jian)測網作(zuo)用,基(ji)本形成土壤(rang)環(huan)(huan)境(jing)監(jian)(jian)(jian)測能力。各(ge)省(區、市)每年(nian)至(zhi)少開(kai)展(zhan)1次(ci)土壤(rang)環(huan)(huan)境(jing)監(jian)(jian)(jian)測技術人員(yuan)培訓(xun)。各(ge)地可(ke)根據(ju)工作(zuo)需(xu)要,補充設(she)置(zhi)監(jian)(jian)(jian)測點(dian)位(wei),增加特征污染物監(jian)(jian)(jian)測項目,提高監(jian)(jian)(jian)測頻次(ci)。2020年(nian)底(di)前,實現土壤(rang)環(huan)(huan)境(jing)質(zhi)量(liang)(liang)監(jian)(jian)(jian)測點(dian)位(wei)所有縣(xian)(市、區)全覆蓋。(環(huan)(huan)境(jing)保護部(bu)牽頭(tou),國家發(fa)展(zhan)改(gai)革委、工業(ye)和信(xin)息化部(bu)、國土資(zi)源部(bu)、農業(ye)部(bu)等參(can)與)

(三(san))提(ti)升土(tu)(tu)(tu)壤(rang)環境信(xin)息化管理水平。利(li)用環境保護、國(guo)(guo)土(tu)(tu)(tu)資(zi)源(yuan)、農(nong)業(ye)等(deng)部(bu)(bu)(bu)門相關數(shu)據(ju),建立土(tu)(tu)(tu)壤(rang)環境基礎數(shu)據(ju)庫,構(gou)建全國(guo)(guo)土(tu)(tu)(tu)壤(rang)環境信(xin)息化管理平臺,力爭2018年底前(qian)完(wan)成。借助(zhu)移動(dong)互聯(lian)網、物聯(lian)網等(deng)技術,拓寬數(shu)據(ju)獲取渠道,實現數(shu)據(ju)動(dong)態更新。加強數(shu)據(ju)共(gong)(gong)享(xiang),編制資(zi)源(yuan)共(gong)(gong)享(xiang)目錄,明(ming)確(que)共(gong)(gong)享(xiang)權限和方式,發(fa)揮土(tu)(tu)(tu)壤(rang)環境大數(shu)據(ju)在污染防治(zhi)、城(cheng)鄉規劃、土(tu)(tu)(tu)地利(li)用、農(nong)業(ye)生(sheng)(sheng)產中的(de)作用。(環境保護部(bu)(bu)(bu)牽頭,國(guo)(guo)家(jia)發(fa)展改革(ge)委、教(jiao)育部(bu)(bu)(bu)、科技部(bu)(bu)(bu)、工業(ye)和信(xin)息化部(bu)(bu)(bu)、國(guo)(guo)土(tu)(tu)(tu)資(zi)源(yuan)部(bu)(bu)(bu)、住房城(cheng)鄉建設部(bu)(bu)(bu)、農(nong)業(ye)部(bu)(bu)(bu)、國(guo)(guo)家(jia)衛生(sheng)(sheng)計生(sheng)(sheng)委、國(guo)(guo)家(jia)林業(ye)局等(deng)參與)

二、推進(jin)土壤污染防治立(li)法,建立(li)健(jian)全法規標準體(ti)系(xi)

(四)加快推進立法(fa)(fa)(fa)(fa)進程。配合(he)(he)完成土壤(rang)污(wu)(wu)染(ran)(ran)防治(zhi)(zhi)法(fa)(fa)(fa)(fa)起草工(gong)(gong)作。適時修訂(ding)污(wu)(wu)染(ran)(ran)防治(zhi)(zhi)、城鄉規(gui)(gui)劃、土地管(guan)理、農(nong)(nong)(nong)產(chan)品質(zhi)量安全(quan)相關法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規(gui)(gui),增加土壤(rang)污(wu)(wu)染(ran)(ran)防治(zhi)(zhi)有(you)關內容。2016年(nian)(nian)底前,完成農(nong)(nong)(nong)藥管(guan)理條例(li)修訂(ding)工(gong)(gong)作,發布污(wu)(wu)染(ran)(ran)地塊土壤(rang)環(huan)(huan)境管(guan)理辦(ban)法(fa)(fa)(fa)(fa)、農(nong)(nong)(nong)用(yong)地土壤(rang)環(huan)(huan)境管(guan)理辦(ban)法(fa)(fa)(fa)(fa)。2017年(nian)(nian)底前,出臺農(nong)(nong)(nong)藥包裝廢棄物回收處理、工(gong)(gong)礦(kuang)用(yong)地土壤(rang)環(huan)(huan)境管(guan)理、廢棄農(nong)(nong)(nong)膜回收利(li)用(yong)等部(bu)門規(gui)(gui)章。到2020年(nian)(nian),土壤(rang)污(wu)(wu)染(ran)(ran)防治(zhi)(zhi)法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規(gui)(gui)體系(xi)基本建(jian)立。各地可結合(he)(he)實(shi)際,研究制(zhi)定土壤(rang)污(wu)(wu)染(ran)(ran)防治(zhi)(zhi)地方性法(fa)(fa)(fa)(fa)規(gui)(gui)。(國(guo)(guo)務院(yuan)法(fa)(fa)(fa)(fa)制(zhi)辦(ban)、環(huan)(huan)境保護(hu)部(bu)牽頭,工(gong)(gong)業和信息化部(bu)、國(guo)(guo)土資源(yuan)部(bu)、住房城鄉建(jian)設部(bu)、農(nong)(nong)(nong)業部(bu)、國(guo)(guo)家林業局等參與)

(五)系統構建(jian)(jian)標(biao)(biao)(biao)準(zhun)(zhun)體系。健全(quan)土(tu)(tu)壤(rang)(rang)(rang)污(wu)染(ran)防(fang)治(zhi)相關標(biao)(biao)(biao)準(zhun)(zhun)和(he)(he)技(ji)(ji)術規范。2017年底前,發(fa)布農(nong)用(yong)地、建(jian)(jian)設用(yong)地土(tu)(tu)壤(rang)(rang)(rang)環(huan)境(jing)質(zhi)(zhi)量(liang)標(biao)(biao)(biao)準(zhun)(zhun);完(wan)成土(tu)(tu)壤(rang)(rang)(rang)環(huan)境(jing)監(jian)測、調查評估、風險(xian)管控(kong)、治(zhi)理與修(xiu)復(fu)等(deng)(deng)技(ji)(ji)術規范以(yi)及環(huan)境(jing)影響評價技(ji)(ji)術導則制(zhi)修(xiu)訂(ding)(ding)工作;修(xiu)訂(ding)(ding)肥料、飼料、灌溉用(yong)水中(zhong)(zhong)有毒(du)有害物質(zhi)(zhi)限(xian)量(liang)和(he)(he)農(nong)用(yong)污(wu)泥中(zhong)(zhong)污(wu)染(ran)物控(kong)制(zhi)等(deng)(deng)標(biao)(biao)(biao)準(zhun)(zhun),進一(yi)步嚴(yan)(yan)格污(wu)染(ran)物控(kong)制(zhi)要(yao)求(qiu);修(xiu)訂(ding)(ding)農(nong)膜標(biao)(biao)(biao)準(zhun)(zhun),提高(gao)厚(hou)度要(yao)求(qiu),研(yan)究制(zhi)定可(ke)降解農(nong)膜標(biao)(biao)(biao)準(zhun)(zhun);修(xiu)訂(ding)(ding)農(nong)藥包裝(zhuang)標(biao)(biao)(biao)準(zhun)(zhun),增加(jia)防(fang)止農(nong)藥包裝(zhuang)廢(fei)棄物污(wu)染(ran)土(tu)(tu)壤(rang)(rang)(rang)的要(yao)求(qiu)。適(shi)時(shi)修(xiu)訂(ding)(ding)污(wu)染(ran)物排(pai)放標(biao)(biao)(biao)準(zhun)(zhun),進一(yi)步明確污(wu)染(ran)物特別排(pai)放限(xian)值要(yao)求(qiu)。完(wan)善(shan)土(tu)(tu)壤(rang)(rang)(rang)中(zhong)(zhong)污(wu)染(ran)物分析(xi)測試方(fang)法,研(yan)制(zhi)土(tu)(tu)壤(rang)(rang)(rang)環(huan)境(jing)標(biao)(biao)(biao)準(zhun)(zhun)樣品。各(ge)地可(ke)制(zhi)定嚴(yan)(yan)于國(guo)家標(biao)(biao)(biao)準(zhun)(zhun)的地方(fang)土(tu)(tu)壤(rang)(rang)(rang)環(huan)境(jing)質(zhi)(zhi)量(liang)標(biao)(biao)(biao)準(zhun)(zhun)。(環(huan)境(jing)保護部(bu)牽頭,工業和(he)(he)信息化部(bu)、國(guo)土(tu)(tu)資源部(bu)、住(zhu)房城鄉建(jian)(jian)設部(bu)、水利部(bu)、農(nong)業部(bu)、質(zhi)(zhi)檢總局(ju)(ju)、國(guo)家林業局(ju)(ju)等(deng)(deng)參(can)與)

(六)全(quan)面強化監管(guan)執法(fa)。明確監管(guan)重(zhong)點(dian)(dian)。重(zhong)點(dian)(dian)監測土壤中鎘(ge)、汞、砷、鉛、鉻(ge)等(deng)重(zhong)金(jin)屬(shu)和(he)多環芳烴、石油(you)烴等(deng)有(you)機污染(ran)物,重(zhong)點(dian)(dian)監管(guan)有(you)色金(jin)屬(shu)礦采(cai)選、有(you)色金(jin)屬(shu)冶煉、石油(you)開采(cai)、石油(you)加(jia)工、化工、焦化、電鍍(du)、制革等(deng)行業(ye),以(yi)及產(chan)糧(liang)(油(you))大縣、地級以(yi)上城(cheng)市(shi)建成區等(deng)區域。(環境保護部(bu)(bu)牽頭,工業(ye)和(he)信(xin)息化部(bu)(bu)、國土資源(yuan)部(bu)(bu)、住房城(cheng)鄉建設部(bu)(bu)、農業(ye)部(bu)(bu)等(deng)參與)

加大執(zhi)(zhi)(zhi)法力度。將土(tu)壤(rang)污(wu)(wu)(wu)染(ran)(ran)防治作(zuo)為(wei)環(huan)境(jing)執(zhi)(zhi)(zhi)法的(de)重要內容,充分利用(yong)(yong)環(huan)境(jing)監管網格,加強土(tu)壤(rang)環(huan)境(jing)日常監管執(zhi)(zhi)(zhi)法。嚴厲打擊非法排放(fang)有(you)毒有(you)害污(wu)(wu)(wu)染(ran)(ran)物(wu)、違(wei)法違(wei)規(gui)存放(fang)危險(xian)化學品、非法處置(zhi)危險(xian)廢物(wu)、不正常使用(yong)(yong)污(wu)(wu)(wu)染(ran)(ran)治理(li)(li)設施、監測數(shu)據弄(nong)虛作(zuo)假等(deng)環(huan)境(jing)違(wei)法行為(wei)。開(kai)展(zhan)重點行業企業專項環(huan)境(jing)執(zhi)(zhi)(zhi)法,對(dui)嚴重污(wu)(wu)(wu)染(ran)(ran)土(tu)壤(rang)環(huan)境(jing)、群(qun)眾反映強烈的(de)企業進行掛牌(pai)督辦。改善基層環(huan)境(jing)執(zhi)(zhi)(zhi)法條件(jian),配(pei)備必要的(de)土(tu)壤(rang)污(wu)(wu)(wu)染(ran)(ran)快(kuai)速(su)檢(jian)測等(deng)執(zhi)(zhi)(zhi)法裝備。對(dui)全(quan)(quan)國(guo)(guo)環(huan)境(jing)執(zhi)(zhi)(zhi)法人員(yuan)每3年開(kai)展(zhan)1輪土(tu)壤(rang)污(wu)(wu)(wu)染(ran)(ran)防治專業技術培訓。提高(gao)突(tu)發環(huan)境(jing)事件(jian)應急(ji)能力,完(wan)善各級環(huan)境(jing)污(wu)(wu)(wu)染(ran)(ran)事件(jian)應急(ji)預案,加強環(huan)境(jing)應急(ji)管理(li)(li)、技術支撐、處置(zhi)救(jiu)援(yuan)能力建設。(環(huan)境(jing)保護部牽頭,工業和信(xin)息(xi)化部、公安部、國(guo)(guo)土(tu)資源(yuan)部、住房(fang)城鄉建設部、農業部、安全(quan)(quan)監管總(zong)局、國(guo)(guo)家林業局等(deng)參與)

三、實施農(nong)用地分類(lei)管理,保障農(nong)業生產環(huan)境安全

(七)劃(hua)定農(nong)用(yong)地(di)(di)(di)(di)土(tu)(tu)壤(rang)(rang)(rang)環境(jing)(jing)(jing)質量(liang)類(lei)(lei)別(bie)。按污(wu)染(ran)程(cheng)度(du)將農(nong)用(yong)地(di)(di)(di)(di)劃(hua)為(wei)(wei)三個類(lei)(lei)別(bie),未污(wu)染(ran)和輕微污(wu)染(ran)的劃(hua)為(wei)(wei)優先保護類(lei)(lei),輕度(du)和中度(du)污(wu)染(ran)的劃(hua)為(wei)(wei)安全(quan)利用(yong)類(lei)(lei),重度(du)污(wu)染(ran)的劃(hua)為(wei)(wei)嚴(yan)格管(guan)控類(lei)(lei),以耕(geng)(geng)(geng)地(di)(di)(di)(di)為(wei)(wei)重點,分(fen)別(bie)采取(qu)相應管(guan)理措(cuo)施,保障農(nong)產品質量(liang)安全(quan)。2017年(nian)底(di)前(qian),發(fa)布農(nong)用(yong)地(di)(di)(di)(di)土(tu)(tu)壤(rang)(rang)(rang)環境(jing)(jing)(jing)質量(liang)類(lei)(lei)別(bie)劃(hua)分(fen)技術指(zhi)南。以土(tu)(tu)壤(rang)(rang)(rang)污(wu)染(ran)狀況詳查結果為(wei)(wei)依據(ju),開(kai)展耕(geng)(geng)(geng)地(di)(di)(di)(di)土(tu)(tu)壤(rang)(rang)(rang)和農(nong)產品協同監(jian)測與(yu)(yu)評價(jia),在試點基礎上有序(xu)推(tui)進耕(geng)(geng)(geng)地(di)(di)(di)(di)土(tu)(tu)壤(rang)(rang)(rang)環境(jing)(jing)(jing)質量(liang)類(lei)(lei)別(bie)劃(hua)定,逐(zhu)步建立分(fen)類(lei)(lei)清單(dan),2020年(nian)底(di)前(qian)完成。劃(hua)定結果由各(ge)省級人民政府(fu)審定,數據(ju)上傳全(quan)國(guo)土(tu)(tu)壤(rang)(rang)(rang)環境(jing)(jing)(jing)信(xin)息(xi)化管(guan)理平臺(tai)。根據(ju)土(tu)(tu)地(di)(di)(di)(di)利用(yong)變更和土(tu)(tu)壤(rang)(rang)(rang)環境(jing)(jing)(jing)質量(liang)變化情況,定期對各(ge)類(lei)(lei)別(bie)耕(geng)(geng)(geng)地(di)(di)(di)(di)面積、分(fen)布等(deng)信(xin)息(xi)進行更新。有條件的地(di)(di)(di)(di)區要逐(zhu)步開(kai)展林地(di)(di)(di)(di)、草地(di)(di)(di)(di)、園地(di)(di)(di)(di)等(deng)其他(ta)農(nong)用(yong)地(di)(di)(di)(di)土(tu)(tu)壤(rang)(rang)(rang)環境(jing)(jing)(jing)質量(liang)類(lei)(lei)別(bie)劃(hua)定等(deng)工(gong)作(zuo)。(環境(jing)(jing)(jing)保護部、農(nong)業部牽頭,國(guo)土(tu)(tu)資源(yuan)部、國(guo)家林業局等(deng)參(can)與(yu)(yu))

(八)切實加大保(bao)(bao)護(hu)(hu)(hu)(hu)(hu)力度(du)。各(ge)地(di)要將符(fu)合條件(jian)的(de)(de)優先(xian)保(bao)(bao)護(hu)(hu)(hu)(hu)(hu)類耕地(di)劃為(wei)永久基本農(nong)(nong)(nong)(nong)田,實行(xing)(xing)嚴格保(bao)(bao)護(hu)(hu)(hu)(hu)(hu),確保(bao)(bao)其面積(ji)不(bu)(bu)減(jian)少、土壤環(huan)(huan)境質(zhi)量(liang)不(bu)(bu)下(xia)降(jiang),除(chu)法律(lv)規定的(de)(de)重點建設(she)項目選址確實無法避讓外,其他任何建設(she)不(bu)(bu)得占用(yong)(yong)。產糧(liang)(油)大縣要制(zhi)定土壤環(huan)(huan)境保(bao)(bao)護(hu)(hu)(hu)(hu)(hu)方案。高標準農(nong)(nong)(nong)(nong)田建設(she)項目向(xiang)優先(xian)保(bao)(bao)護(hu)(hu)(hu)(hu)(hu)類耕地(di)集(ji)中的(de)(de)地(di)區(qu)傾(qing)斜。推行(xing)(xing)秸稈還田、增(zeng)施(shi)(shi)(shi)有機肥(fei)、少耕免耕、糧(liang)豆輪作、農(nong)(nong)(nong)(nong)膜(mo)減(jian)量(liang)與回收利用(yong)(yong)等(deng)措(cuo)施(shi)(shi)(shi)。繼續(xu)開展黑土地(di)保(bao)(bao)護(hu)(hu)(hu)(hu)(hu)利用(yong)(yong)試點。農(nong)(nong)(nong)(nong)村土地(di)流轉的(de)(de)受(shou)讓方要履行(xing)(xing)土壤保(bao)(bao)護(hu)(hu)(hu)(hu)(hu)的(de)(de)責任,避免因過度(du)施(shi)(shi)(shi)肥(fei)、濫用(yong)(yong)農(nong)(nong)(nong)(nong)藥等(deng)掠奪式(shi)(shi)農(nong)(nong)(nong)(nong)業(ye)生產方式(shi)(shi)造成土壤環(huan)(huan)境質(zhi)量(liang)下(xia)降(jiang)。各(ge)省(sheng)級人(ren)民政(zheng)府要對本行(xing)(xing)政(zheng)區(qu)域內優先(xian)保(bao)(bao)護(hu)(hu)(hu)(hu)(hu)類耕地(di)面積(ji)減(jian)少或土壤環(huan)(huan)境質(zhi)量(liang)下(xia)降(jiang)的(de)(de)縣(市(shi)、區(qu)),進行(xing)(xing)預警(jing)提醒并依法采取環(huan)(huan)評(ping)限(xian)批等(deng)限(xian)制(zhi)性(xing)措(cuo)施(shi)(shi)(shi)。(國(guo)土資源部(bu)(bu)、農(nong)(nong)(nong)(nong)業(ye)部(bu)(bu)牽頭(tou),國(guo)家發展改革委、環(huan)(huan)境保(bao)(bao)護(hu)(hu)(hu)(hu)(hu)部(bu)(bu)、水利部(bu)(bu)等(deng)參與)

防控企業(ye)污染。嚴格控制在優(you)先保護類耕地集中(zhong)區域新建有色(se)金(jin)屬冶煉(lian)、石油加工、化(hua)工、焦化(hua)、電(dian)鍍(du)、制革(ge)等(deng)行業(ye)企業(ye),現(xian)有相關(guan)行業(ye)企業(ye)要采用(yong)新技術、新工藝,加快提(ti)標升級(ji)改造步伐。(環(huan)境保護部、國家發展改革(ge)委牽頭(tou),工業(ye)和信(xin)息化(hua)部參(can)與)

(九)著(zhu)力推(tui)進安(an)全利用。根據土(tu)壤污(wu)染(ran)狀況和農(nong)(nong)產(chan)品超(chao)(chao)標情(qing)況,安(an)全利用類耕(geng)地(di)(di)集中(zhong)的(de)縣(市、區)要結合當地(di)(di)主(zhu)要作物品種和種植習慣,制定實(shi)施(shi)受(shou)污(wu)染(ran)耕(geng)地(di)(di)安(an)全利用方案,采取農(nong)(nong)藝調控、替代種植等措(cuo)施(shi),降低農(nong)(nong)產(chan)品超(chao)(chao)標風險。強化農(nong)(nong)產(chan)品質量檢(jian)測。加強對農(nong)(nong)民(min)、農(nong)(nong)民(min)合作社(she)的(de)技術(shu)指(zhi)導和培訓。2017年底前,出(chu)臺受(shou)污(wu)染(ran)耕(geng)地(di)(di)安(an)全利用技術(shu)指(zhi)南。到(dao)2020年,輕度(du)和中(zhong)度(du)污(wu)染(ran)耕(geng)地(di)(di)實(shi)現安(an)全利用的(de)面積達到(dao)4000萬畝(mu)。(農(nong)(nong)業部(bu)牽頭,國(guo)土(tu)資源部(bu)等參(can)與)

(十(shi))全面落(luo)實嚴格管(guan)(guan)(guan)控(kong)。加強對嚴格管(guan)(guan)(guan)控(kong)類(lei)耕(geng)(geng)地(di)的(de)用(yong)途管(guan)(guan)(guan)理,依(yi)法劃(hua)定特定農(nong)產品禁止生(sheng)產區域,嚴禁種(zhong)植食用(yong)農(nong)產品;對威脅地(di)下水(shui)、飲(yin)用(yong)水(shui)水(shui)源安(an)全的(de),有關縣(市、區)要制(zhi)(zhi)定環境(jing)風險管(guan)(guan)(guan)控(kong)方案,并落(luo)實有關措施。研究將嚴格管(guan)(guan)(guan)控(kong)類(lei)耕(geng)(geng)地(di)納入國家(jia)新一輪(lun)退耕(geng)(geng)還(huan)林還(huan)草(cao)(cao)實施范圍,制(zhi)(zhi)定實施重(zhong)度污染耕(geng)(geng)地(di)種(zhong)植結構調(diao)整(zheng)或退耕(geng)(geng)還(huan)林還(huan)草(cao)(cao)計劃(hua)。繼續在湖南(nan)長株潭地(di)區開展重(zhong)金屬(shu)污染耕(geng)(geng)地(di)修(xiu)復(fu)及農(nong)作物種(zhong)植結構調(diao)整(zheng)試(shi)(shi)點(dian)。實行耕(geng)(geng)地(di)輪(lun)作休耕(geng)(geng)制(zhi)(zhi)度試(shi)(shi)點(dian)。到2020年,重(zhong)度污染耕(geng)(geng)地(di)種(zhong)植結構調(diao)整(zheng)或退耕(geng)(geng)還(huan)林還(huan)草(cao)(cao)面積力爭達到2000萬畝。(農(nong)業(ye)部牽頭(tou),國家(jia)發(fa)展改革委、財政部、國土(tu)資源部、環境(jing)保護(hu)部、水(shui)利部、國家(jia)林業(ye)局參與)

(十一)加強林地(di)(di)草(cao)地(di)(di)園(yuan)地(di)(di)土壤環境管(guan)理(li)。嚴格控制林地(di)(di)、草(cao)地(di)(di)、園(yuan)地(di)(di)的(de)農藥使用量,禁(jin)止使用高毒、高殘留農藥。完善生物農藥、引誘劑管(guan)理(li)制度(du),加大使用推廣力度(du)。優先將(jiang)重度(du)污染的(de)牧(mu)草(cao)地(di)(di)集中(zhong)區域納入禁(jin)牧(mu)休牧(mu)實施范圍。加強對重度(du)污染林地(di)(di)、園(yuan)地(di)(di)產出(chu)食用農(林)產品質量檢(jian)測,發(fa)現超(chao)標的(de),要采取種(zhong)植結構調整等措施。(農業部、國(guo)家林業局負責)

四、實施建設(she)用地準入管理,防范(fan)人居(ju)環境風險

(十二)明確管理要求。建(jian)立調(diao)(diao)查(cha)評(ping)估(gu)制(zhi)度。2016年(nian)(nian)底前(qian),發布建(jian)設(she)用地(di)(di)(di)土(tu)(tu)壤環境調(diao)(diao)查(cha)評(ping)估(gu)技術(shu)規定(ding)。自2017年(nian)(nian)起(qi),對擬收(shou)回(hui)土(tu)(tu)地(di)(di)(di)使(shi)用權的(de)(de)有色金(jin)屬冶(ye)煉、石(shi)油加工、化工、焦化、電鍍、制(zhi)革等行(xing)業(ye)(ye)企業(ye)(ye)用地(di)(di)(di),以及用途擬變更(geng)為(wei)居(ju)住和商業(ye)(ye)、學校、醫療、養老機構(gou)等公(gong)共設(she)施的(de)(de)上述企業(ye)(ye)用地(di)(di)(di),由(you)土(tu)(tu)地(di)(di)(di)使(shi)用權人(ren)負(fu)責(ze)開(kai)(kai)展(zhan)(zhan)土(tu)(tu)壤環境狀況調(diao)(diao)查(cha)評(ping)估(gu);已經收(shou)回(hui)的(de)(de),由(you)所(suo)(suo)(suo)在地(di)(di)(di)市、縣(xian)級人(ren)民政府負(fu)責(ze)開(kai)(kai)展(zhan)(zhan)調(diao)(diao)查(cha)評(ping)估(gu)。自2018年(nian)(nian)起(qi),重度污染農用地(di)(di)(di)轉為(wei)城(cheng)鎮建(jian)設(she)用地(di)(di)(di)的(de)(de),由(you)所(suo)(suo)(suo)在地(di)(di)(di)市、縣(xian)級人(ren)民政府負(fu)責(ze)組織開(kai)(kai)展(zhan)(zhan)調(diao)(diao)查(cha)評(ping)估(gu)。調(diao)(diao)查(cha)評(ping)估(gu)結果向所(suo)(suo)(suo)在地(di)(di)(di)環境保護、城(cheng)鄉規劃(hua)、國(guo)土(tu)(tu)資源部門備案。(環境保護部牽(qian)頭(tou),國(guo)土(tu)(tu)資源部、住房城(cheng)鄉建(jian)設(she)部參與)

分用(yong)途明確管(guan)理(li)措(cuo)施(shi)。自2017年起,各地(di)要結合土(tu)壤污(wu)染(ran)狀況(kuang)詳查情況(kuang),根(gen)據(ju)建設(she)用(yong)地(di)土(tu)壤環(huan)境調查評估結果,逐步(bu)建立污(wu)染(ran)地(di)塊名錄及其開(kai)發利用(yong)的(de)負(fu)面清(qing)單,合理(li)確定(ding)土(tu)地(di)用(yong)途。符合相應(ying)規劃(hua)用(yong)地(di)土(tu)壤環(huan)境質量要求(qiu)的(de)地(di)塊,可進入用(yong)地(di)程序。暫(zan)不開(kai)發利用(yong)或(huo)現(xian)階(jie)段不具(ju)備治(zhi)理(li)修復(fu)條件的(de)污(wu)染(ran)地(di)塊,由所在地(di)縣級人民政府組織劃(hua)定(ding)管(guan)控區域,設(she)立標識,發布(bu)公告,開(kai)展土(tu)壤、地(di)表(biao)水、地(di)下水、空氣環(huan)境監測;發現(xian)污(wu)染(ran)擴散的(de),有關責(ze)任主體(ti)要及時(shi)采取污(wu)染(ran)物(wu)隔離、阻(zu)斷等環(huan)境風險(xian)管(guan)控措(cuo)施(shi)。(國土(tu)資源部(bu)(bu)牽頭,環(huan)境保護(hu)部(bu)(bu)、住房城鄉建設(she)部(bu)(bu)、水利部(bu)(bu)等參與(yu))

(十三)落實監管責(ze)(ze)任。地(di)(di)方(fang)各級城鄉(xiang)規劃(hua)部(bu)門(men)(men)要結合土(tu)壤環境質量狀(zhuang)況(kuang),加(jia)強(qiang)城鄉(xiang)規劃(hua)論(lun)證和審批管理。地(di)(di)方(fang)各級國土(tu)資源(yuan)部(bu)門(men)(men)要依據土(tu)地(di)(di)利用總體規劃(hua)、城鄉(xiang)規劃(hua)和地(di)(di)塊土(tu)壤環境質量狀(zhuang)況(kuang),加(jia)強(qiang)土(tu)地(di)(di)征收、收回(hui)、收購以及轉讓、改變用途等(deng)環節的監管。地(di)(di)方(fang)各級環境保(bao)護部(bu)門(men)(men)要加(jia)強(qiang)對建(jian)設用地(di)(di)土(tu)壤環境狀(zhuang)況(kuang)調查、風險(xian)評估和污染(ran)地(di)(di)塊治理與(yu)修復活(huo)動的監管。建(jian)立城鄉(xiang)規劃(hua)、國土(tu)資源(yuan)、環境保(bao)護等(deng)部(bu)門(men)(men)間(jian)的信息(xi)溝通(tong)機制,實行聯動監管。(國土(tu)資源(yuan)部(bu)、環境保(bao)護部(bu)、住房城鄉(xiang)建(jian)設部(bu)負責(ze)(ze))

(十四(si))嚴格用(yong)地準(zhun)入(ru)(ru)。將建(jian)設用(yong)地土(tu)(tu)壤環(huan)境管理要求納(na)入(ru)(ru)城市規(gui)劃(hua)(hua)和供地管理,土(tu)(tu)地開發(fa)利用(yong)必須符合土(tu)(tu)壤環(huan)境質量要求。地方各(ge)級國土(tu)(tu)資源(yuan)(yuan)、城鄉規(gui)劃(hua)(hua)等部(bu)門在(zai)編制土(tu)(tu)地利用(yong)總(zong)體(ti)規(gui)劃(hua)(hua)、城市總(zong)體(ti)規(gui)劃(hua)(hua)、控制性詳細規(gui)劃(hua)(hua)等相關規(gui)劃(hua)(hua)時,應(ying)充分考慮(lv)污染地塊的環(huan)境風險,合理確定土(tu)(tu)地用(yong)途。(國土(tu)(tu)資源(yuan)(yuan)部(bu)、住房城鄉建(jian)設部(bu)牽頭(tou),環(huan)境保護部(bu)參(can)與)

五、強化未污染(ran)土壤(rang)保(bao)護,嚴控新增土壤(rang)污染(ran)

(十五)加(jia)強未(wei)利(li)用(yong)(yong)(yong)地(di)(di)環(huan)境(jing)(jing)管理。按照(zhao)科學(xue)有序原則開(kai)(kai)(kai)(kai)發(fa)利(li)用(yong)(yong)(yong)未(wei)利(li)用(yong)(yong)(yong)地(di)(di),防止造成土(tu)壤(rang)污染。擬(ni)開(kai)(kai)(kai)(kai)發(fa)為(wei)農用(yong)(yong)(yong)地(di)(di)的,有關縣(市、區)人民政府要(yao)組織開(kai)(kai)(kai)(kai)展(zhan)土(tu)壤(rang)環(huan)境(jing)(jing)質量狀(zhuang)況評(ping)估(gu);不符合相應標準的,不得種植食用(yong)(yong)(yong)農產品。各地(di)(di)要(yao)加(jia)強納(na)入耕地(di)(di)后備資源(yuan)的未(wei)利(li)用(yong)(yong)(yong)地(di)(di)保護,定期(qi)開(kai)(kai)(kai)(kai)展(zhan)巡查。依法(fa)嚴查向沙(sha)漠、灘(tan)涂(tu)、鹽堿(jian)地(di)(di)、沼(zhao)澤地(di)(di)等非法(fa)排污、傾倒有毒有害(hai)物質的環(huan)境(jing)(jing)違法(fa)行為(wei)。加(jia)強對礦山(shan)、油田等礦產資源(yuan)開(kai)(kai)(kai)(kai)采活動影響(xiang)區域(yu)內未(wei)利(li)用(yong)(yong)(yong)地(di)(di)的環(huan)境(jing)(jing)監管,發(fa)現土(tu)壤(rang)污染問題(ti)的,要(yao)及時(shi)督促有關企業采取防治措施。推動鹽堿(jian)地(di)(di)土(tu)壤(rang)改良,自(zi)2017年起,在新疆生(sheng)產建設兵(bing)團等地(di)(di)開(kai)(kai)(kai)(kai)展(zhan)利(li)用(yong)(yong)(yong)燃煤電(dian)廠脫硫(liu)石(shi)膏改良鹽堿(jian)地(di)(di)試點。(環(huan)境(jing)(jing)保護部(bu)(bu)、國土(tu)資源(yuan)部(bu)(bu)牽頭,國家發(fa)展(zhan)改革(ge)委、公(gong)安部(bu)(bu)、水(shui)利(li)部(bu)(bu)、農業部(bu)(bu)、國家林業局(ju)等參與(yu))

(十六)防范建(jian)(jian)設(she)用地(di)新增污(wu)染(ran)。排放重點(dian)污(wu)染(ran)物的(de)建(jian)(jian)設(she)項目,在開展(zhan)環境(jing)影響評(ping)價時(shi),要增加對土(tu)壤(rang)環境(jing)影響的(de)評(ping)價內(nei)容,并提出防范土(tu)壤(rang)污(wu)染(ran)的(de)具體措(cuo)施(shi);需要建(jian)(jian)設(she)的(de)土(tu)壤(rang)污(wu)染(ran)防治(zhi)設(she)施(shi),要與主體工(gong)程(cheng)同(tong)時(shi)設(she)計、同(tong)時(shi)施(shi)工(gong)、同(tong)時(shi)投產(chan)使用;有(you)關環境(jing)保護部(bu)門(men)要做好有(you)關措(cuo)施(shi)落實情況的(de)監督管理(li)工(gong)作(zuo)。自2017年起,有(you)關地(di)方人民政府要與重點(dian)行業(ye)企業(ye)簽訂(ding)土(tu)壤(rang)污(wu)染(ran)防治(zhi)責(ze)(ze)任書(shu),明確(que)相關措(cuo)施(shi)和責(ze)(ze)任,責(ze)(ze)任書(shu)向社會公開。(環境(jing)保護部(bu)負(fu)責(ze)(ze))

(十(shi)七)強化(hua)(hua)空(kong)間布(bu)局(ju)(ju)(ju)管控。加強規劃(hua)區劃(hua)和(he)(he)建設(she)項(xiang)目布(bu)局(ju)(ju)(ju)論證,根(gen)據(ju)土壤(rang)等(deng)(deng)(deng)(deng)環境承載能力,合(he)(he)(he)理確(que)定(ding)(ding)區域功能定(ding)(ding)位(wei)、空(kong)間布(bu)局(ju)(ju)(ju)。鼓勵(li)工(gong)業(ye)(ye)企(qi)業(ye)(ye)集聚發展,提高土地節約集約利(li)用(yong)水平,減(jian)少土壤(rang)污(wu)染。嚴(yan)格執行相關行業(ye)(ye)企(qi)業(ye)(ye)布(bu)局(ju)(ju)(ju)選址要(yao)求,禁止在居(ju)民區、學校、醫(yi)療和(he)(he)養老機構等(deng)(deng)(deng)(deng)周邊新(xin)建有色(se)金屬冶煉、焦化(hua)(hua)等(deng)(deng)(deng)(deng)行業(ye)(ye)企(qi)業(ye)(ye);結合(he)(he)(he)推進新(xin)型城鎮(zhen)化(hua)(hua)、產業(ye)(ye)結構調(diao)整和(he)(he)化(hua)(hua)解過剩產能等(deng)(deng)(deng)(deng),有序搬遷或(huo)依(yi)法(fa)關閉對土壤(rang)造成(cheng)嚴(yan)重污(wu)染的(de)現有企(qi)業(ye)(ye)。結合(he)(he)(he)區域功能定(ding)(ding)位(wei)和(he)(he)土壤(rang)污(wu)染防治需(xu)要(yao),科學布(bu)局(ju)(ju)(ju)生(sheng)活垃圾(ji)處(chu)理、危險廢物處(chu)置、廢舊資源再生(sheng)利(li)用(yong)等(deng)(deng)(deng)(deng)設(she)施和(he)(he)場所,合(he)(he)(he)理確(que)定(ding)(ding)畜禽(qin)養殖(zhi)布(bu)局(ju)(ju)(ju)和(he)(he)規模(mo)。(國家發展改革委牽頭,工(gong)業(ye)(ye)和(he)(he)信息化(hua)(hua)部(bu)、國土資源部(bu)、環境保(bao)護部(bu)、住房城鄉建設(she)部(bu)、水利(li)部(bu)、農(nong)業(ye)(ye)部(bu)、國家林業(ye)(ye)局(ju)(ju)(ju)等(deng)(deng)(deng)(deng)參與)

六、加強(qiang)污(wu)染(ran)源監管(guan),做好土壤污(wu)染(ran)預防(fang)工作(zuo)

(十八(ba))嚴控工(gong)礦污(wu)染。加強(qiang)日常(chang)環(huan)(huan)境(jing)(jing)(jing)監(jian)管(guan)。各地(di)要(yao)根(gen)據工(gong)礦企(qi)(qi)業分布和污(wu)染排(pai)放情況,確(que)定土(tu)(tu)(tu)壤(rang)環(huan)(huan)境(jing)(jing)(jing)重(zhong)(zhong)點監(jian)管(guan)企(qi)(qi)業名(ming)單,實(shi)行動(dong)態更新,并(bing)向社會公(gong)布。列(lie)入名(ming)單的(de)企(qi)(qi)業每年(nian)要(yao)自行對其用地(di)進行土(tu)(tu)(tu)壤(rang)環(huan)(huan)境(jing)(jing)(jing)監(jian)測,結(jie)(jie)果向社會公(gong)開。有(you)關(guan)環(huan)(huan)境(jing)(jing)(jing)保護(hu)部(bu)門(men)要(yao)定期對重(zhong)(zhong)點監(jian)管(guan)企(qi)(qi)業和工(gong)業園區周邊開展監(jian)測,數據及時上傳全(quan)國土(tu)(tu)(tu)壤(rang)環(huan)(huan)境(jing)(jing)(jing)信(xin)息(xi)化(hua)管(guan)理平(ping)臺(tai),結(jie)(jie)果作為環(huan)(huan)境(jing)(jing)(jing)執法(fa)和風險(xian)預警的(de)重(zhong)(zhong)要(yao)依據。適時修(xiu)訂國家鼓勵的(de)有(you)毒有(you)害原料(產品)替代品目(mu)錄。加強(qiang)電器電子、汽車等(deng)(deng)工(gong)業產品中(zhong)有(you)害物質控制。有(you)色(se)金屬冶(ye)煉、石油加工(gong)、化(hua)工(gong)、焦(jiao)化(hua)、電鍍、制革(ge)等(deng)(deng)行業企(qi)(qi)業拆除生產設(she)施設(she)備(bei)、構(gou)筑物和污(wu)染治(zhi)理設(she)施,要(yao)事先制定殘留污(wu)染物清理和安全(quan)處(chu)(chu)置方案,并(bing)報所(suo)在地(di)縣級環(huan)(huan)境(jing)(jing)(jing)保護(hu)、工(gong)業和信(xin)息(xi)化(hua)部(bu)門(men)備(bei)案;要(yao)嚴格按照有(you)關(guan)規(gui)定實(shi)施安全(quan)處(chu)(chu)理處(chu)(chu)置,防范(fan)拆除活動(dong)污(wu)染土(tu)(tu)(tu)壤(rang)。2017年(nian)底前,發布企(qi)(qi)業拆除活動(dong)污(wu)染防治(zhi)技(ji)術規(gui)定。(環(huan)(huan)境(jing)(jing)(jing)保護(hu)部(bu)、工(gong)業和信(xin)息(xi)化(hua)部(bu)負責)

嚴防(fang)礦(kuang)(kuang)(kuang)產(chan)資源(yuan)開(kai)(kai)發(fa)污染土(tu)壤。自2017年起(qi),內(nei)蒙古、江西(xi)、河南、湖北、湖南、廣(guang)東、廣(guang)西(xi)、四(si)川、貴州、云南、陜西(xi)、甘肅、新(xin)疆等(deng)省(sheng)(區(qu))礦(kuang)(kuang)(kuang)產(chan)資源(yuan)開(kai)(kai)發(fa)活動(dong)集中(zhong)的(de)區(qu)域,執行重(zhong)點(dian)污染物特(te)別排放(fang)限值。全(quan)面整治(zhi)歷史遺留尾礦(kuang)(kuang)(kuang)庫(ku),完善覆膜、壓土(tu)、排洪、堤壩加(jia)固等(deng)隱(yin)患治(zhi)理(li)和閉(bi)庫(ku)措施。有重(zhong)點(dian)監(jian)管(guan)尾礦(kuang)(kuang)(kuang)庫(ku)的(de)企業(ye)要開(kai)(kai)展環(huan)境(jing)風險(xian)評估,完善污染治(zhi)理(li)設施,儲(chu)備應急物資。加(jia)強(qiang)對(dui)礦(kuang)(kuang)(kuang)產(chan)資源(yuan)開(kai)(kai)發(fa)利用活動(dong)的(de)輻(fu)射(she)安全(quan)監(jian)管(guan),有關企業(ye)每年要對(dui)本礦(kuang)(kuang)(kuang)區(qu)土(tu)壤進行輻(fu)射(she)環(huan)境(jing)監(jian)測。(環(huan)境(jing)保護部、安全(quan)監(jian)管(guan)總局牽頭,工業(ye)和信息化部、國土(tu)資源(yuan)部參與)

加(jia)強涉(she)重(zhong)金(jin)屬(shu)(shu)(shu)行(xing)業(ye)污染(ran)防控。嚴格執行(xing)重(zhong)金(jin)屬(shu)(shu)(shu)污染(ran)物排放(fang)標準(zhun)(zhun)并(bing)落(luo)(luo)實相關總量控制指標,加(jia)大監督(du)檢查力度(du),對整(zheng)改后仍不達標的(de)企(qi)業(ye),依法責(ze)令其停業(ye)、關閉,并(bing)將(jiang)企(qi)業(ye)名單向社會公開。繼續淘(tao)汰(tai)(tai)涉(she)重(zhong)金(jin)屬(shu)(shu)(shu)重(zhong)點行(xing)業(ye)落(luo)(luo)后產(chan)能,完善重(zhong)金(jin)屬(shu)(shu)(shu)相關行(xing)業(ye)準(zhun)(zhun)入條件,禁止新建(jian)落(luo)(luo)后產(chan)能或產(chan)能嚴重(zhong)過剩行(xing)業(ye)的(de)建(jian)設項目。按計(ji)劃逐步淘(tao)汰(tai)(tai)普通照明白熾燈(deng)。提(ti)高(gao)鉛酸蓄電(dian)池(chi)等行(xing)業(ye)落(luo)(luo)后產(chan)能淘(tao)汰(tai)(tai)標準(zhun)(zhun),逐步退出落(luo)(luo)后產(chan)能。制定(ding)涉(she)重(zhong)金(jin)屬(shu)(shu)(shu)重(zhong)點工(gong)業(ye)行(xing)業(ye)清潔(jie)生產(chan)技術(shu)推行(xing)方案,鼓勵企(qi)業(ye)采用(yong)先進(jin)適用(yong)生產(chan)工(gong)藝和技術(shu)。2020年重(zhong)點行(xing)業(ye)的(de)重(zhong)點重(zhong)金(jin)屬(shu)(shu)(shu)排放(fang)量要比2013年下降10%。(環境保護部、工(gong)業(ye)和信息化部牽頭,國家發展改革委參與)

強(qiang)(qiang)化畜禽(qin)養(yang)(yang)(yang)殖(zhi)污染防治。嚴(yan)格(ge)規范獸(shou)藥、飼料添加(jia)(jia)劑的(de)生產和使用,防止過量(liang)(liang)使用,促進源(yuan)頭(tou)減量(liang)(liang)。加(jia)(jia)強(qiang)(qiang)畜禽(qin)糞便(bian)(bian)綜合利(li)(li)用,在(zai)部(bu)分生豬大縣(xian)開展(zhan)種養(yang)(yang)(yang)業(ye)有機結合、循環(huan)發展(zhan)試點。鼓勵支持畜禽(qin)糞便(bian)(bian)處理(li)利(li)(li)用設施(shi)(shi)建設,到2020年,規模化養(yang)(yang)(yang)殖(zhi)場、養(yang)(yang)(yang)殖(zhi)小區配套建設廢棄物處理(li)設施(shi)(shi)比例達(da)到75%以(yi)上(shang)。(農業(ye)部(bu)牽(qian)頭(tou),國家發展(zhan)改革委、環(huan)境保護(hu)部(bu)參與)

加強灌(guan)溉(gai)(gai)(gai)水水質(zhi)(zhi)(zhi)管(guan)理(li)。開展灌(guan)溉(gai)(gai)(gai)水水質(zhi)(zhi)(zhi)監(jian)測。灌(guan)溉(gai)(gai)(gai)用(yong)水應符合農田灌(guan)溉(gai)(gai)(gai)水水質(zhi)(zhi)(zhi)標準。對因長(chang)期使用(yong)污(wu)水灌(guan)溉(gai)(gai)(gai)導(dao)致(zhi)土壤污(wu)染嚴(yan)重(zhong)、威(wei)脅(xie)農產(chan)品質(zhi)(zhi)(zhi)量安全的,要及時調整種(zhong)植結構。(水利部牽頭,農業部參與)

七(qi)、開展(zhan)污染治理與(yu)修復,改善區(qu)域土壤(rang)環境質量

(二十三(san))有(you)序開(kai)展(zhan)(zhan)治(zhi)(zhi)理(li)(li)與(yu)(yu)(yu)(yu)修復(fu)。確定治(zhi)(zhi)理(li)(li)與(yu)(yu)(yu)(yu)修復(fu)重點。各(ge)地要(yao)結合城市環(huan)(huan)境質量提(ti)升和(he)發展(zhan)(zhan)布局調(diao)整,以擬(ni)開(kai)發建(jian)設居住、商業、學校、醫療和(he)養老(lao)機(ji)構等項目的(de)污染地塊(kuai)為重點,開(kai)展(zhan)(zhan)治(zhi)(zhi)理(li)(li)與(yu)(yu)(yu)(yu)修復(fu)。在江西、湖(hu)(hu)北、湖(hu)(hu)南(nan)、廣東(dong)、廣西、四川、貴州、云南(nan)等省(sheng)份(fen)污染耕(geng)地集中(zhong)區域優先組織開(kai)展(zhan)(zhan)治(zhi)(zhi)理(li)(li)與(yu)(yu)(yu)(yu)修復(fu);其(qi)他省(sheng)份(fen)要(yao)根(gen)據耕(geng)地土(tu)壤污染程度、環(huan)(huan)境風險及(ji)其(qi)影響范圍,確定治(zhi)(zhi)理(li)(li)與(yu)(yu)(yu)(yu)修復(fu)的(de)重點區域。到2020年,受污染耕(geng)地治(zhi)(zhi)理(li)(li)與(yu)(yu)(yu)(yu)修復(fu)面積達到1000萬畝。(國(guo)土(tu)資源(yuan)部(bu)、農業部(bu)、環(huan)(huan)境保護(hu)部(bu)牽頭,住房城鄉建(jian)設部(bu)參與(yu)(yu)(yu)(yu))

強(qiang)化治(zhi)理與(yu)修(xiu)復(fu)工(gong)(gong)程監管(guan)。治(zhi)理與(yu)修(xiu)復(fu)工(gong)(gong)程原則上在原址進行(xing)(xing),并采取必要(yao)(yao)措(cuo)(cuo)(cuo)施防止污染土壤(rang)挖掘、堆存等造成二次污染;需要(yao)(yao)轉運污染土壤(rang)的,有(you)關責任(ren)(ren)單(dan)位要(yao)(yao)將運輸時間、方式、線路和(he)污染土壤(rang)數量、去向(xiang)、最(zui)終處置措(cuo)(cuo)(cuo)施等,提前向(xiang)所(suo)在地(di)和(he)接收地(di)環境(jing)保(bao)護(hu)部(bu)(bu)門(men)報(bao)告。工(gong)(gong)程施工(gong)(gong)期(qi)間,責任(ren)(ren)單(dan)位要(yao)(yao)設立公告牌,公開工(gong)(gong)程基本情況(kuang)、環境(jing)影響及其防范措(cuo)(cuo)(cuo)施;所(suo)在地(di)環境(jing)保(bao)護(hu)部(bu)(bu)門(men)要(yao)(yao)對各項環境(jing)保(bao)護(hu)措(cuo)(cuo)(cuo)施落實(shi)情況(kuang)進行(xing)(xing)檢查。工(gong)(gong)程完工(gong)(gong)后,責任(ren)(ren)單(dan)位要(yao)(yao)委托(tuo)第三方機構(gou)對治(zhi)理與(yu)修(xiu)復(fu)效果(guo)進行(xing)(xing)評估,結果(guo)向(xiang)社會(hui)公開。實(shi)行(xing)(xing)土壤(rang)污染治(zhi)理與(yu)修(xiu)復(fu)終身(shen)責任(ren)(ren)制(zhi),2017年底前,出臺有(you)關責任(ren)(ren)追究辦法。(環境(jing)保(bao)護(hu)部(bu)(bu)牽頭,國土資源部(bu)(bu)、住房城鄉建(jian)設部(bu)(bu)、農業部(bu)(bu)參與(yu))

(二十(shi)九)發(fa)揮市場作用。通過政府和(he)社會資(zi)本合(he)作(PPP)模式,發(fa)揮財(cai)政資(zi)金(jin)撬動功能,帶動更多社會資(zi)本參與土壤污(wu)染(ran)(ran)防治(zhi)(zhi)。加大(da)政府購買服務力度(du),推動受污(wu)染(ran)(ran)耕(geng)地和(he)以政府為(wei)責任主體的(de)污(wu)染(ran)(ran)地塊(kuai)治(zhi)(zhi)理與修(xiu)復。積(ji)極(ji)發(fa)展(zhan)綠色(se)金(jin)融(rong),發(fa)揮政策(ce)性和(he)開(kai)發(fa)性金(jin)融(rong)機(ji)構引導作用,為(wei)重大(da)土壤污(wu)染(ran)(ran)防治(zhi)(zhi)項目提供(gong)支持。鼓勵(li)符(fu)合(he)條件的(de)土壤污(wu)染(ran)(ran)治(zhi)(zhi)理與修(xiu)復企(qi)業(ye)(ye)發(fa)行股票。探索通過發(fa)行債券推進土壤污(wu)染(ran)(ran)治(zhi)(zhi)理與修(xiu)復,在土壤污(wu)染(ran)(ran)綜合(he)防治(zhi)(zhi)先行區開(kai)展(zhan)試(shi)點。有(you)序開(kai)展(zhan)重點行業(ye)(ye)企(qi)業(ye)(ye)環(huan)境污(wu)染(ran)(ran)強制責任保(bao)(bao)險試(shi)點。(國家發(fa)展(zhan)改革委、環(huan)境保(bao)(bao)護部(bu)牽頭(tou),財(cai)政部(bu)、人民銀(yin)行、銀(yin)監會、證監會、保(bao)(bao)監會等參與)

(三十(shi))加強社會監(jian)督(du)。推進信息公(gong)開(kai)。根據土(tu)(tu)壤環(huan)境(jing)質(zhi)量監(jian)測和調查結果,適時發(fa)布全國土(tu)(tu)壤環(huan)境(jing)狀況(kuang)。各(ge)(ge)省(區(qu)、市)人民政(zheng)府定(ding)期公(gong)布本(ben)行(xing)政(zheng)區(qu)域(yu)各(ge)(ge)地級(ji)市(州、盟)土(tu)(tu)壤環(huan)境(jing)狀況(kuang)。重點(dian)行(xing)業企業要依據有關規(gui)定(ding),向社會公(gong)開(kai)其產生(sheng)的污(wu)染(ran)物名稱、排放方(fang)式、排放濃度、排放總量,以(yi)及污(wu)染(ran)防(fang)治設(she)(she)施(shi)建設(she)(she)和運行(xing)情況(kuang)。(環(huan)境(jing)保護部(bu)牽頭,國土(tu)(tu)資源部(bu)、住房(fang)城鄉(xiang)建設(she)(she)部(bu)、農業部(bu)等參與)

引導公(gong)眾參與(yu)。實行(xing)有獎舉報(bao),鼓勵(li)公(gong)眾通過(guo)“12369”環(huan)保(bao)舉報(bao)熱線、信函、電子(zi)郵件(jian)、政府網站、微信平臺等(deng)(deng)途徑,對亂(luan)排廢水、廢氣,亂(luan)倒廢渣、污(wu)(wu)泥等(deng)(deng)污(wu)(wu)染(ran)土壤(rang)的(de)環(huan)境(jing)(jing)違法(fa)行(xing)為進行(xing)監督。有條(tiao)件(jian)的(de)地方(fang)可根據需要(yao)聘請環(huan)境(jing)(jing)保(bao)護義務監督員,參與(yu)現(xian)場環(huan)境(jing)(jing)執(zhi)法(fa)、土壤(rang)污(wu)(wu)染(ran)事件(jian)調查(cha)處理等(deng)(deng)。鼓勵(li)種糧(liang)大戶(hu)、家(jia)庭農場、農民(min)合作社以(yi)及民(min)間環(huan)境(jing)(jing)保(bao)護機構參與(yu)土壤(rang)污(wu)(wu)染(ran)防治(zhi)工作。(環(huan)境(jing)(jing)保(bao)護部(bu)牽頭,國土資源部(bu)、住房城(cheng)鄉建設(she)部(bu)、農業部(bu)等(deng)(deng)參與(yu))

推(tui)動公(gong)(gong)(gong)益(yi)訴(su)(su)訟。鼓勵依法(fa)對污染土(tu)(tu)壤等環境違(wei)(wei)法(fa)行(xing)(xing)為(wei)提(ti)起(qi)公(gong)(gong)(gong)益(yi)訴(su)(su)訟。開展檢(jian)察機(ji)關(guan)提(ti)起(qi)公(gong)(gong)(gong)益(yi)訴(su)(su)訟改革試(shi)點(dian)的(de)地區,檢(jian)察機(ji)關(guan)可以(yi)以(yi)公(gong)(gong)(gong)益(yi)訴(su)(su)訟人(ren)(ren)(ren)的(de)身份(fen),對污染土(tu)(tu)壤等損害(hai)社(she)會公(gong)(gong)(gong)共利益(yi)的(de)行(xing)(xing)為(wei)提(ti)起(qi)民事公(gong)(gong)(gong)益(yi)訴(su)(su)訟;也可以(yi)對負有土(tu)(tu)壤污染防治(zhi)職責的(de)行(xing)(xing)政機(ji)關(guan),因違(wei)(wei)法(fa)行(xing)(xing)使職權或者不作為(wei)造成國家(jia)和社(she)會公(gong)(gong)(gong)共利益(yi)受(shou)到侵害(hai)的(de)行(xing)(xing)為(wei)提(ti)起(qi)行(xing)(xing)政公(gong)(gong)(gong)益(yi)訴(su)(su)訟。地方各(ge)級(ji)人(ren)(ren)(ren)民政府和有關(guan)部(bu)(bu)門(men)應當(dang)積(ji)極配合司(si)法(fa)機(ji)關(guan)的(de)相關(guan)案件(jian)辦(ban)理工作和檢(jian)察機(ji)關(guan)的(de)監督(du)工作。(最高人(ren)(ren)(ren)民檢(jian)察院(yuan)、最高人(ren)(ren)(ren)民法(fa)院(yuan)牽頭,國土(tu)(tu)資源部(bu)(bu)、環境保護部(bu)(bu)、住房城鄉建設部(bu)(bu)、水(shui)利部(bu)(bu)、農業(ye)部(bu)(bu)、國家(jia)林業(ye)局等參與)

(三十四)落實(shi)企業(ye)(ye)責(ze)任(ren)(ren)。有(you)關企業(ye)(ye)要(yao)(yao)加強內部(bu)管(guan)理(li),將土壤污(wu)染(ran)防(fang)治(zhi)(zhi)納入(ru)環境(jing)風險防(fang)控體系(xi),嚴格(ge)依法(fa)依規(gui)建(jian)設和(he)(he)運營(ying)污(wu)染(ran)治(zhi)(zhi)理(li)設施,確保(bao)重點污(wu)染(ran)物穩定(ding)達標排放。造成土壤污(wu)染(ran)的,應承(cheng)擔損害評估、治(zhi)(zhi)理(li)與(yu)修(xiu)復(fu)的法(fa)律(lv)責(ze)任(ren)(ren)。逐步建(jian)立土壤污(wu)染(ran)治(zhi)(zhi)理(li)與(yu)修(xiu)復(fu)企業(ye)(ye)行業(ye)(ye)自律(lv)機制。國(guo)有(you)企業(ye)(ye)特別是中央企業(ye)(ye)要(yao)(yao)帶頭(tou)落實(shi)。(環境(jing)保(bao)護部(bu)牽(qian)頭(tou),工業(ye)(ye)和(he)(he)信息化部(bu)、國(guo)務院國(guo)資委(wei)等參與(yu))

(三十五)嚴(yan)格評(ping)(ping)(ping)估考(kao)(kao)(kao)核。實行目(mu)(mu)標責任制(zhi)。2016年(nian)底前,國務(wu)院與各(ge)省(區(qu)、市)人民政府簽訂土壤污(wu)染防治(zhi)目(mu)(mu)標責任書(shu),分(fen)解落實目(mu)(mu)標任務(wu)。分(fen)年(nian)度對(dui)各(ge)省(區(qu)、市)重點工作進展情況進行評(ping)(ping)(ping)估,2020年(nian)對(dui)本行動計劃實施情況進行考(kao)(kao)(kao)核,評(ping)(ping)(ping)估和(he)(he)考(kao)(kao)(kao)核結果作為(wei)對(dui)領(ling)導(dao)班子和(he)(he)領(ling)導(dao)干(gan)部綜(zong)合(he)考(kao)(kao)(kao)核評(ping)(ping)(ping)價、自然資源資產離任審計的重要(yao)依(yi)據。(環境保護(hu)部牽(qian)頭,中央組織部、審計署參與)

對(dui)年度評(ping)估結果(guo)較差或未通過(guo)考核的(de)省(sheng)(區、市),要提(ti)出限期整(zheng)改意見,整(zheng)改完成(cheng)(cheng)前,對(dui)有(you)關(guan)(guan)地區實(shi)施建設項目環(huan)(huan)評(ping)限批;整(zheng)改不到位的(de),要約談有(you)關(guan)(guan)省(sheng)級(ji)人民(min)政府(fu)及其相關(guan)(guan)部(bu)(bu)門負(fu)責(ze)(ze)人。對(dui)土壤環(huan)(huan)境(jing)問題突出、區域土壤環(huan)(huan)境(jing)質量明(ming)顯下(xia)降(jiang)、防治(zhi)工作不力、群眾反映(ying)強烈的(de)地區,要約談有(you)關(guan)(guan)地市級(ji)人民(min)政府(fu)和(he)省(sheng)級(ji)人民(min)政府(fu)相關(guan)(guan)部(bu)(bu)門主要負(fu)責(ze)(ze)人。對(dui)失職瀆(du)職、弄虛(xu)作假的(de),區分(fen)情節(jie)輕重(zhong),予以誡勉(mian)、責(ze)(ze)令(ling)公開道(dao)歉、組(zu)(zu)織處(chu)理或黨紀政紀處(chu)分(fen);對(dui)構(gou)成(cheng)(cheng)犯罪的(de),要依法追究刑事責(ze)(ze)任,已經調離、提(ti)拔或者退休的(de),也要終身追究責(ze)(ze)任。(環(huan)(huan)境(jing)保護部(bu)(bu)牽頭,中央組(zu)(zu)織部(bu)(bu)、監察部(bu)(bu)參與(yu))
